Terms & Conditions For Candidates

The following Definitions apply:

The ‘Agency’ refers to Transcend ChildCare Talent.

​

"The “Applicant” refers to an individual who engages with the Agency's services to pursue a position in a private residence.

 

The 'Client' refers to an individual who engages the Agency to secure a nanny or maternity, or any other child care professional in exchange for a fee.

 

The Agency does not impose a fee for Applicants to register with the Agency.

 

1. The Applicant acknowledges that the Agency operates solely as an introduction and referral service, providing its Clients with details about potential Candidates in return for a fee.

2. The Applicant agrees to provide the Agency with information that is truthful, and precise. This includes providing a comprehensive account of their employment history, along with contactable references.

3. The Applicant's information will solely be disclosed to Clients by the Agency. Under no circumstances will the Agency divulge the Applicant's personal information to any third parties without the Applicant's explicit consent, in accordance with our Privacy Policy.

4. The Applicant will grant permission to the Agency to advertise their personal details while endeavoring to secure a suitable position for them. This permission may be provided verbally or in writing, and may encompass contact details.

5. Both the Applicant and the Agency acknowledge that there exists no employer-employee relationship between them.

6. The Agency commits to provide the Client with information that is truthful and precise regarding an Applicant.

7. The Applicant may consent to a "trial day" with the Client, provided that the Agency has been notified. This trial day will not exceed one 10-hour period, and the Client agrees to compensate the Applicant with one full day's payment at a mutually agreed pre-negotiated rate.

8. The Applicant must promptly notify the Agency if they receive a direct or indirect offer of employment from the Client or if the Client contacts them directly without permission from the Agency.

9. The Agency does not offer and cannot be held liable for any representations or warranties regarding negotiating wages, loss of wages, alterations in working conditions, or termination that may arise from or result in employment with the Client.

10. The Applicant is not legally obligated to work for a specific Client.

11.The Agency is not obligated to secure a job to any Applicant who has undergone an interview. We operate as a referral service and offer no assurance that the ideal position will be secured.

12. The Agency does not offer any legal advice to either the Client or the Applicant concerning the employment contract.

13. The Applicant agrees that the Agency and its agents, shall not be liable to the Applicant, or to any other person/persons, for incidental or consequential losses, expenses, demands, claims damages, injuries, causes of any actions directly or indirectly of every kind arising out of or resulting from the action of the Agency or any information released by the Agency.

14. The Applicant agrees that all information exchanged between the Agency and the Applicant concerning any Clients is strictly confidential and will not be disclosed to any third parties without the consent of the Agency.

15. These Terms and Conditions govern all contracts and agreements made between the Applicant and the Agency, and are considered accepted by the Applicant upon the completion of the Registration Form.
